Note
(*) Oversea cash withdrawal/cash advance transaction limit is based on the amount debited by VND in VIB card system and the amount shall be included cash withdrawal fee/cash advance fee and administration fee applied for oversea transactions.

For Virtual cards, the maximum transaction limit does not exceed 50 million VND/time (not applicable to transactions via MyVIB and Internet banking).
VIB Credit Card Cardholder Agreement
1. Notification regarding the issuance of the Card
The notification of approval for the issuance of the Card includes information regarding the Cardholder's name, type of Card, Credit Limit, and other details as stipulated by VIB at any given time. This informtion will be communicated to the Cardholder at the moment VIB approves the issuance of the VIB credit Card.
2. General Responsibility of Cardholder
2.1 The Cardholder must provide complete, accurate, and timely information, documents, and data as required by VIB to verify and identify the Cardholder when registering for the issuance and use of the card. During the use of the card, the Cardholder is responsible for the authenticity of the information, documents, and data provided.
2.2 The person to whom the Card is issued (“Cardholder”) (1) will sign the Card immediately upon receipt, (2) and will not permit any other person to use it, (3) and will at all times safeguard the Card and any Personal Identification Number (the PIN) issued, Supplementary Identification Number, card information, and transactions (4) and keep it under his/her personal control
2.3 The Cardholder must use the credit limit provided through the Card for the lawful purposes registered with VIB. The Cardholder is responsible for all Card Transactions (whether voluntarily or involuntarily conducted by the Cardholder) listed in the Statement as per Article 8, as well as all related fees and interest specified below, regardless of the termination of this Agreement.
2.4 The Cardholder may only conduct Card Transactions through electronic means after ensuring that the identification documents and biometric information of the Cardholder match and comply with the legal regulations and VIB's requirements at any given time.
3. Limit
3.1 Credit Limit: The bank will assign a credit limit to the Card Account based on supervisory evaluation of credit risks assessment related to the Card Account or Cardholder and the information that VIB has acquired. The bank have right to terminate, change (increase or decrease) credit limit to such amount as fit as VIB terminates, and modify the limit automatically, or Cardholder’ request.
The bank will notify the Cardholder in advance of any change in limit.
3.2 Availability Limit: is the maximum amount the Cardholder is allowed to spend at any one time. Availability Limit equal credit limit minus the total outstanding balance of transactions on the Card but unpaid (including outstanding balance of charges and interest) at each time ("Existing Outstanding Balance") plus the balance on the Card Account at any time (if any).
3.3 Transaction Limit: each card is issued a limit for each type of transaction, including the purchase of goods, services, cash withdrawal and other forms of transactions ("Card Transactions"), which are determined by VIB in its sole discretion in each period.
3.4 Cardholders have the right to request VIB to increase or decrease their Credit Limit. Based on the Cardholder's request, VIB reserves the right to approve or decline the adjustment of the Credit Limit in accordance with VIB's current policies.
4. Card Transactions
4.1 Cash withdrawal transaction is any type of transaction in which the Cardholder receives cash or cash equivalents through an ATM or other channels.
4.2 For purchase of goods, services, the bank has no responsibility for the method of supplying the goods and any refusal of the merchant establishment (except for technical errors related to the use of the VIB Card). No claim by the Cardholder against the merchant establishment will relieve the Cardholder from any obligation to the Bank hereunder. The Bank has the right not to set up, modify or terminate any such arrangement in the event of any dispute between the Cardholder and the merchant establishment.
4.3 All Card Transactions conducted in currencies other than Vietnamese Dong will be debited from the Card Account after being converted to Vietnamses Dong, plus the foreign currency transaction management fee as stipulated by VIB in the service fee and interest rate schedule, as follows:
- Transactions conducted in US Dollars will be converted to Vietnamese Dong.
- Transactions conducted in all currencies other than US Dollars or Vietnamese Dong will be converted directly to Vietnamese Dong or first converted to US Dollars and then to Vietnamese Dong.
- The exchange rate will be determined according to the regulations set by the corresponding International Card Organizations for the issued Card brand and/or VIB's regulations at any given time in the service fee and interest rate schedule. The exchange rate used will be the rate applicable on the day the transaction is recorded in the Cardholder's Account (to clarify, the rate on the transaction date does not apply).
4.4 Card Transactions selected to be conducted in Vietnamese Dong at foreign merchants or at merchants managed by foreign entities will be subject to the conversion method and exchange rate as determined by the ATM operator or the respective merchant.
(Foreign merchants or those managed by foreign entities are identified by VIB based on the transaction location parameters established by the seller with the payment bank according to the regulations of the International Card Organizations.)
These Card Transactions will be debited from the Card Account after adding the foreign transaction management fee in Vietnamese Dong, or other fees as stipulated by VIB and specified in the service fee and interest rate schedule
4.5 The Cardholder is not permitted to use the Card for purposes such as: transferring funds, depositing money, crediting the payment account, debit card, or prepaid card of the Cardholder or a third party (not a merchant); withdrawing cash at the merchant's POS, depositing money into an e-wallet, or making payments for goods and services that do not comply with legal regulations.
4.6 The Cardhoder shall not use the Card to conduct payment transaction on foreign websites that do not comply with the laws of Vietnam (such as: buying and selling foreign currency; stocks; cryptocurrrencies; ambling; betting…)
4.7 The Cardholder shall not use the Card for fraudulent purposes, deceitful activities, or any other illegal activities.
4.8 VIB has the right and obligation to monitor and supervise the use of the Card and the repayment by the Cardholder, ensuring the full and timely recovery of principal, interest, and fees as agreed, as well request the Cardholder to report on the use of the credit limit through the Card and to provide documents and data proving that the credit limit is used for the intended purpose.
To avoid misunderstanding: the obligations of VIB under this clause are obligations to the State Bank of Vietnam and relevant regulatory authorities, not obligations to the Cardholder; the Cardholder must fulfill their obligations as stipulated in this Agreement independently and separately, regardless of VIB's fulfillment of its obligations.
5. Card benefits
The Bank may from time to time introduce new products/services to be made available to Cardholders which shall be governed by specific terms of such products/services and. In case of any conflict between these specific terms and the terms herein, the former shall prevail.
6. Loss, Theft or Misuse of Card or PIN
6.1 In the event that the Card and/or PIN is lost, stolen, disclosed, or exploited to conduct fraudulent or counterfeit transactions (collectively referred to as "Card Misuse"), the Cardholder must immediately notify any branch or business unit of VIB or the 24/7 Customer Care Department at the phone number updated on VIB's official website. After notifying, the Cardholder must formally confirm this notification in writing to VIB.
VIB will acknowledge the receipt of the notification from the Cardholder in writing, via email, through the 24/7 Customer Care Department, or by any means deemed appropriate by VIB within 10 working days from the date VIB receives the written notification from the Cardholder.
6.2 In the event of Card Misuse occurring before VIB has locked the card (the time of card locking will be specified in the acknowledgment as per Article 6.1 regarding the processing of the notification received from the Cardholder), the Cardholder shall bear full responsibility for any losses and compensate for damages caused by the misuse of the Card. The Cardholder acknowledges and agrees that they remain responsible for paying VIB all amounts due, including fees, interest, and outstanding balances from transactions that were misused, prior to VIB's acknowledgment on the payment due date as stated in the Statement.
6.3 In the case of Card Misuse (except for electronic payment transactions) occurring after VIB has locked the card (the time of card locking will be specified in the acknowledgment as per Article 6.1 regarding the processing of the notification received from the Cardholder), VIB Is obligated to compensate the Cardholder for damages resulting from the misuse of the Card that occurred after the card was locked.
7. Resolution of Complaints and Handling
7.1 Inquiries and complaints relating to the Card (if any) are received at any bank’s branches or business units or through Customer Care Hotline 24/7 by phone number updated on the official website of VIB. Checking form, complaint form of the bank is required in any inquiry, complaint. If the Cardholder asks for a check or complaint through the Customer Care Hotline 24/7, the Cardholder must add a Request for Inspection and Complaints within five (5) business days. If the Cardholder authorizes another person to request a review, the Cardholder shall comply with the provisions of the law on authorization and in accordance with this Terms and Conditions.
7.2 If the Cardholder authorizes another person to request a review, the Cardholder shall comply with the provisions of the law on authorization and in accordance with this Terms and Conditions.
7.3 Claims related to card transactions must comply with the provisions of VIB and each international card organization that the Card represents. VIB and the Cardholder resolve the complaint will be bound by and the result of the investigation, the complaint shall be governed by these regulations.
7.4 The Cardholder must return the Card to VIB within one working day from the time VIB receives the initial inquiry or complaint regarding suspected fraudulent or counterfeit transactions, including but not limited to transactions made with a counterfeit Card and/or other cases as requested by VIB.
7.5 In order to request an investigation or complaint regarding suspected fraudulent or counterfeit transactions, the Cardholder is obligated to provide VIB with the following information and documentation:
- Related to the Cardholder: necessary information, documents, and data required to verify the Cardholder's identity, ensuring it matches the information stored at VIB, in accordance with VIB's regulations at any given time.
- Related to the transaction under investigation or complaint: Card number/Card account number, number of transactions, transaction value, merchant accepting the Card, transaction time, transaction outcome, and any other information as requested by VIB.
In cases where the request for investigation or complaint pertains to fraudulent or counterfeit transactions and the Cardholder must return the Card to VIB: A record of Card retrieval or documentation proving that the Cardholder is in possession of the investigation or complaint and is being at a geographical distance too far from the nearest VIB transaction location; and a copy of the passport in cases where, at the time of the transaction, the country differs from the country where the documentation proving that the Cardholder did not participate in the transaction. In instances where the Cardholder is abroad, documentation proving that the Cardholder cannot return the Card within the specified timeframe includes, but is not limited to: a scanned copy sent via email/a photo sent via phone showing the front of the Card and the passport page indicating the date of entry with the customs stamp of the country where the Cardholder entered; or a fax containing an image of the front of the Card and noting the fax number with the country code of the Cardholder's residence. The timeframe for providing these documents is one business day from the moment VIB acknowledges receipt of the initial investigation request when such a request/complaint arises.
7.6 The timeframe within which the Cardholder has the right to request an investigation or complaint shall not exceed 60 calendar days from timeframe shall be 5 business days shall not bear any responsibility if investigation or complaint beyond the aforementioned timeframe. The maximum processing time for the complaint shall not exceed 55 calendar days per instance from the date VIB receives the Cardholder's request for investigation or complaint or from the date the Card Transaction in question is debited to the Card Account (whichever occurs later).
7.7 In the event of losses incurred not due to the Cardholder's fault and/or not in case of force majeure agreement. According to the results of the investigation, the bank will reimburse the Cardholder within 5 working days from the date of notification of the results of the investigation and settlement of the complaint. After the expiry of the inspection process, the fourth complaint (04) but the cause or fault of the party has not been determined, within the next 15 working days, the bank will agree with the Cardholder about handling options.
7.8 In case of crime signs, the bank will notify the competent state agency in accordance with the provisions of criminal procedure law and report to the State Bank (Payment Department, the Housing Bank country branches in provinces and cities in the locality); At the same time, notify the Cardholder in writing of the handling status of the request for investigation and complaint. In cases where competent state agencies notify the results of the settlement without criminal elements, within 15 working days after the conclusion of the competent state agencies, VIB shall implement the agreement. with the cardholder about the plan to handle the results of the investigation and complaint.
7.9 If the Cardholder does not agree with the bank's findings and claims, the investigation and settlement shall be settled in accordance with the provisions of the law.
7.10 At VIB's sole discretion, VIB may choose not to execute any refund or may issue a full or partial refund for the transactions for which the Cardholder has requested an investigation or complaint, either immediately and/or after receiving a valid request for investigation or complaint. If the Cardholder's request for investigation or complaint is not accepted based on the resolution of the investigation or complaint, in the event that a refund has been issued, VIB reserves the right to reclaim the refunded amount from the Cardholder at any time by debiting the Cardholder's Card Account. This amount shall become due and payable in full to VIB on the Payment Due Date as indicated in the Statement for the billing period in which the amount was debited.
7.11 VIB has the right to refuse requests for review, claims related to the Card after the above claims handling deadline. In addition, VIB has the right to refuse to accept requests for investigations and appeals of Card transactions with a small value or the number of transactions to be verified exceeds the permitted level in accordance with the provisions by each international card organization:
- For cards branded as MasterCard and Visa organizations: Card transactions with a value of less than USD 25 (in words: twenty-five US Dollars) or equivalent. Merchants of the type of tourism and entertainment in accordance with the regulations of international organizations (for example, aviation, car rental, cruise, train, hotel, motel, restaurant, travel agency), type of digital goods (for example: books, music, games, software...) and card transactions worth less than 10 USD (in words: ten US dollars) or equivalent or under 250,000 VND (in words: two hundred fifty thousand VND) at other types of merchants or transactions from the 36th transaction onwards for the reason due to "Transaction not made by cardholder but cardholder's account is still debited", or transaction from 40th onwards for other reasons.
- For cards branded as Amex organizations: Card transactions with a value of less than USD 25 at all types of merchants.
Cardholder is obliged to pay the full amount of these transactions on the Statement and to be responsible for any losses or damages (if any) arising or in connection with such transactions.
8. Statement
8.1 A statement will normally be sent to the Cardholder monthly on the Statement Date (“Statement Date”) with details of (i) the total amount outstanding on the Card Account (“Statement Balance”), (ii) the minimum sum to be paid by the Cardholder in respect of the Statement Balance as determined by the Bank (“Minimum Payment Due”), (iii) the date by which the remaining payment must be made to the Bank (“Payment Due Date”)
8.2 The Cardholder should notify the bank’s branches, business units, or customer service hotline of any invalid or unauthorized transaction listed in any statement made by the Cardholder within sixty (60) days from the date of the statement. The will investigate and handle complaints immediately since the date of receiving proper notification from the cardholder of any invalid transaction by the cardholder in the statement in accordance with the regulation of the VIB in each period. If the Cardholder fails to report within the said period, the transaction(s) shown on the statement will be considered correct and binding on cardholder’ payment obligations.
8.3 The Bank may send the Statement Balance in any form it deems appropriate including an electronic Statement Balance which is applied for Cardholders who are using Personal Internet Banking service or a PDF Statement Balance sent to Cardholders’ emails registered with the Bank, or paper-base statement balance.
9. Payments
9.1 Payments and credits to the Card Account (before 04:00 PM from Monday Friday, or before 11:00 AM) will be applied by the Bank to reduce the existing outstanding balance in the Card Account in the following order:
(1) Annual Member Fee, (2) Finance charges, (3) Cash advance fee, (4) Other changes (over limit fee, late payment fee, …), (5) Cash withdrawal transactions, (6) Outstanding installment payments are due periodically, (7) Purchase of goods, services transaction, (8) Others transactions.
In case the cardholder has bad debts at VIB or is accompanied by other credit institutions, the order of debt reduction is as follows: (1) Cash withdrawal transactions, (2) Outstanding installment payments are due periodically, (3) Purchase of goods, services transaction, (4) Other transactions, (5) Annual fees, (6) Finance charges, (7) Cash withdrawal fees, (8) Other changes (over limit fee, late payment fee, …).
To to clear, with outstanding balances of the same type of transaction, transactions that occour first are given priority for collection first or in any order as the Bank considers appropriate without prior reference to the Cardholder.
9.2 If the Cardholder is required by any applicable laws or regulations to make any deduction or withholding from any sum payable by the Cardholder to the Bank hereunder, then the liability in respect of that deduction or withholding shall be the liability of the Cardholder such that after the making of such deduction or withholding the net payment shall be equal to the amount which the Bank would have received had no such deduction or withholding been made. It shall be the sole responsibility of the Cardholder to effect payment of such deduction or withholding to the relevant authority within the applicable time limit and the Cardholder shall indemnify the Bank for all consequences of the Cardholder’s failure to do so.
9.3 In addition to any general right of set-off or other rights conferred by law or under any other agreement, the Bank may, without notice, combine or consolidate the outstanding balance on the Card Account with any other account(s) which the Cardholder maintains with the Bank or other credit institution and/or VIB have rights to set-off (or similar right) with and funds, rights and interest in the property/assured property of the cardholder, VIB keeps, manages, controls and perform the right to set-off at any time that VIB thinks it is necessary.
9.4 Unless the Bank otherwise specifies, the whole of the outstanding balance on the Card Account together with the amount of any outstanding Card Transactions effected but not yet charged to the Card Account will become immediately due and payable in full to the Bank on termination of this Agreement or on the Cardholder’s bankruptcy or death. The Bank may employ third parties to collect any outstanding. The Cardholder or his estate will be responsible for settling any outstanding on the Card Account (including without limitation any regular payments, whenever charged or debited to the Card Account, under arrangements which are authorized or set up prior to the date of termination of this Agreement or the Cardholder’s bankruptcy or death), and shall keep the Bank indemnified for all reasonable amounts of costs (including legal fees) and expenses reasonably incurred in recovering such outstanding. Pending such repayment, the Bank will be entitled to continue to charge financing charges at its prevailing rate(s).
9.5 Please note that termination of this Agreement will not automatically lead to termination of any merchant auto payment arrangement including, without limitation, auto payment of any annual fee, that are set up or authorized prior to the termination of the Agreement. The Cardholder must directly contact the related merchant(s) who will be responsible for making the necessary arrangements if he/she wishes to modify/terminate any merchant auto payment.
9.6 Without prejudice to the other provisions of this Agreement, if the Cardholder intends to be absent from Vietnam for more than one month, arrangements to settle the Card Account should be made prior to his/her departure
9.7 If the Cardholder fails to pay the whole of the Minimum Payment Due on the Payment Due Date at the latest, outstanding balances will be transferred in overdue debts with the regulations of VIB in each period.
9.8 The Cardholder is fully responsible for settling the entire outstanding balance on the Card Account, including any amounts related to Card Transactions that have been made but not yet reflected in the Card Account balance. This obligation applies to all current and future assets and income of the Cardholder, without any conditions attached.
10. Payment Refusal
10.1 The Card is locked in accordance with Article 13 of this Agreement.;
10.2 Card is inactive
10.3 Expired card or canceled card from the Cardholder/VIB;
10.4 Use of counterfeit cards or those associated with fraudulent transactions, forgery, or fictitious transactions at the Merchant;
10.5 Cards that have been reported lost by the Cardholder;
10.6 EMV chip or magnetic stripe’ problems
10.7 Equipment or payment bank failed to connect successfully with VIB
10.8 PIN entered incorrectly
10.9 The Cardholder's use of the Card to conduct transactions for purposes of money laundering, terrorism financing, fraud, deceit, and other illegal activities;
10.10 The Cardholder has not provided complete information and/or has provided inaccurate transaction verification information (CVC and/or OTP) and/or the biometric information of the Cardholder does not match correctly when conducting transactions via electronic means;
10.11 Availability limit is not sufficient to pay
10.12 The transaction exceeds transaction value/ time, the number of transactions/day, transaction value/day in regulations of VIB (if any);
10.13 The Cardholder has violated the regulations of VIB, the payment bank, or any agreements between the Cardholder and VIB.
10.14 In the event of a suspension of Card Transactions pursuant to Article 14 of this Agreement;
10.15 Other cases in regulations of the bank.
11. Finance Charge & Interest Rate
11.1 Fee
The Cardholder agrees to pay VIB the issuance fee and/or annual fee for maintaining the Card as stipulated in the Service Fee and Interest Rate Schedule of VIB at any given time. These fees will be debited from the Card Account immediately upon issuance of the Card, even if the Card has not been activated or when due, and are non- refundable.
If VIB incurs any legal costs or debt recovery expenses or other costs (which are reasonable recovery, or collection aimed at recovering any amounts owed by the Cardholder under this Agreement) or costs to implement Cardholder's failure to perform or comply with any terms of this Agreement, the Cardholder shall reimburse VIB promptly upon VIB's request for such costs. If the Cardholder fails to reimburse these amounts for claims, lawsuits, remedial measures due to the fees, VIB reserves the right to continue charging interest on the unpaid amount at the interest rate specified in the Service Fee and Interest Rate Schedule applicable at that time.
Notwithstanding Article 3, if the outstanding balance of the Card Account at any time during the period exceeds the Credit Limit granted for the Card Account at that time, VIB has the right to charge an over-limit fee as stipulated in the Service Fee and Interest Rate Schedule of VIB at any given time, and this fee will be debited from the Card Account on the Statement Date as determined by VIB at that time.
If, by the Payment Due Date (before 4 PM from Monday to Friday or before 11 AM on Saturday), VIB does not receive the full Minimum Payment in the Card Account, a late payment fee (as stipulated in the Service Fee and Interest Rate Schedule of VIB at any given time) will be debited from the Card Account immediately after the Payment Due Date and will be reflected on the Statement for the next billing cycle.
Other fees as stipulated in the Service Fee and Interest Rate Schedule of VIB at any given time. The fees or percentage rates regarding fees, costs, or interest mentioned in this Agreement are applied according to the provisions of the Service Fee and Interest Rate Schedule of VIB at any given time. The Cardholder is bound to comply with these regulations of VIB.
11.2 Finance Charge & Interest Rate
For cash withdrawal transactions will be subject to interest from the date the transactions are made until all cash withdrawals are paid fully by VIB regulations each period.
Installment transactions that are settled early repayment will be charged interest from the date of settlement until the outstanding balance of transactions are paid fully by VIB regulations each period.
For purchase of goods, service transactions:
- If VIB recieved your total outstanding balance in full each statement cycle on or before the Payment Due Date: VIB will
+ charge no interest on the ending balance arising in the current statement period and
+ charge interest on the ending balance carried over from previous statement periods, if any (equal to the total amount balance of transactions from previous unpaid statement periods), calculates continously form the previous Statement Date to the date of payment(s) of the transaction(s), at the interest rate specified in Service fee schedule and card interest rate of VIB from time to time.
- If VIB doesn't recieved your total outstanding balance in full each statement cycle on or before the Payment Due Date: VIB will charge interest on the ending balance and new outstanding balances arising during the period, calculated from the date the transaction(s) is made to the date of payment(s) of the transaction(s), at the interest rate specified in Service fee schedule and card interest rate of VIB from time to time.
The bank does not pay interest on the available fund in the card account
11.3 Card schedule of charges is announced at the official website of VIB. the bank has the right to change the tariff at any time that VIB considers appropriate. VIB will notify the Cardholder in one of the following ways: (i) sending the notice by email or (ii) listing at the VIB's headquarter of at branches; or (iii) publishing on the official website of VIB, or (iv) in other forms decided by the bank. The card schedule of changes will be effective since the date stated in the bank's notice but not earlier than 7 days from VIB's notice.
If the Cardholder does not accept any proposed change of fee schedule, the Cardholder ,must terminate the use of card within 7 days since the date the bank notice. In case the cardholder does not terminate the use of card, th Cardholder acknowledges and agrees that the cardholder will be deemed to have accepted the fee schedule.
12. Supplementary Cards
Should the Bank issue a Supplementary Card at the joint request of the Cardholder and Supplementary Cardholder, the Supplementary Cardholder will be bound by the terms and conditions of this Agreement and shall be liable for the use the Supplementary Card, notwithstanding that the Primary Cardholder shall remain liable for the use of both his/her Card and the Supplementary Card and that the Bank shall have complete discretion in recovering charges incurred by the Supplementary Card from either the Primary Cardholder or the Supplementary Cardholder or both. In relation to Clause 16.1 below concerning cancellation of a Supplementary Card, the Cardholder may be liable for any payments arising from the use of the Supplementary Card until it has been returned or until the Bank is able to implement the procedures which apply to lost cards if the Cardholder so requests. The Supplementary Cardholder shall not be liable for the use of the Card by the Primary Cardholder or the use of any other Supplementary Card by any other Supplementary Cardholder.
13. Lock Card Cases
13.1 At the request of the Cardholder/VIB or;
13.2 VIB reserves the right to block the Card without prior notice to the Cardholder in the following cases:
13.2.1 After 30 days from the Payment Due Date, the Cardholder fails to make payment or makes a payment less than the Minimum Payment Amount;
13.2.2 Any loan of the Cardholder at VIB is settled, VIB recalls the debt prematurely, or payments for the Credit Card and/or other loans of the Cardholder at VIB/other credit institutions are overdue;
13.2.3 When the Cardholder, an employee of VIB, resigns and does not meet the conditions for continued use of the Card as per VIB's current regulations;
13.2.4 The Card is pending cancellation due to unpaid outstanding balance/pending documentation as per VIB's regulations at any given time;
13.2.5 The Card is entered with an incorrect PIN three consecutive times at an ATM;
13.2.6 The Card is involved in transactions related to fraud, forgery, or fictitious transactions at the Merchant;
13.2.7 The Card/Cardholder exhibits signs that meet the early risk identification criteria as stipulated by VIB at any given time, including but not limited to criteria regarding transactions, the Merchant where transactions occur, and changes in Card status;
13.2.8 The information/documentation provided by the Cardholder is incomplete as per VIB's regulations, inaccurate, untruthful, or false;
13.2.9 The identification documents of the Cardholder, whether Vietnamese or foreign, or the residency documents of the foreign Cardholder residing in Vietnam are expired, according to the information stored at VIB;
13.2.10 The Cardholder has not completed the verification to ensure that the identification documents and biometric information of the Cardholder and VIB's regulations at any given time (applicable to electronic Card transactions);
13.2.11 The Card information is compromised at the Merchant;
13.2.12 The Card is stolen or lost;
13.2.13 The Cardholder uses the Card to conduct transactions for purposes of money laundering, terrorism financing, fraud, deceit, and other illegal activities;
13.2.14 In cases where the Card is issued through a partnership channel (as indicated in the online international credit card issuance request - "Application Form"):
- After 9 days from the Payment Due Date, if the Cardholder fails to pay the full Minimum Payment Amount at any time ;
- When VIB receives a request from the partner sent to VIB in writing/email/any form of notification as per the agreement between VIB and the partner;
13.2.15 The Cardholder notifies that no transaction will be conducted;
13.2.16 The Cardholder violates any obligations under this Agreement or VIB's regulations at any given time. VIB has the sole discretion to decide whether or not to restore the provision of Card services to the Cardholder (except in cases from 13.2.6 to 13.2.16 mentioned above). In cases where VIB does not restore the provision of Card services (including cases from 13.2.6 to 13.2.16 mentioned above), the Card will be confiscated and/or rendered inactive according to the provisions of this Agreement.
14. Cases of Suspension of Card Transactions
In the event that VIB undertakes upgrades, modifications, or enhancements to technological solutions and/or systems, due to force majeure, or other circumstances as stipulated by law, VIB reserves the right to decide to suspend Card Transactions, the duration of the suspension, as well as the notification to the Cardholder regarding the suspension and the duration of such suspension.
15. Seize Card Cases
The bank has the right to seize the card if the Cardholder violates the following:
15.1 Fake cards;
15.2 The card is used illegally;
15.3 Card users cannot prove themselves as Cardholders;
15.4 The Cardholder does not comply with the regulations of the bank and International Card Organization as members on the use of the card;
15.5 Card is entered PIN 3 times incorrectly in succession;
15.6 VIB detects or suspects that the Cardholder is using false documents, information, or data, impersonation to issue the card or use the card for fraudulent purposes, deceit, or other illegal activities;
15.7 Serving the investigation and handling of crimes in accordance with the law;
15.8 Other cases as regulated by the bank in each period.
16. Invalid Use of the Card
16.1 The Cardholder can terminate the card at any time by sending a notice with the return of the card and any other Supplementary Cards as required by the bank on termination of card use in each period.
16.2 VIB may terminate this Agreement at the same time with termination of use of the Card by the Cardholder at any time with a prior written notice of at least five (5) working days to the Cardholder or without notice before any of the following occurs:
16.2.1 The Cardholder does not receive the Card within 90 days from the date the Card is issued (new / renewal/ reissue/replacement) on the VIB Card management system.
16.2.2 The cardholder has any outstanding loans at the bank that are terminated, withdrawn prematurely and do not supplement the records as prescribed by VIB within 45 days, or the application is not approved to continue the card.
16.2.3 Cardholder has overdue card/loan over 90 days
16.2.4 Cardholder involved in credit fraud (information, records and card use)
16.2.5 The Cardholder performs, organizes or facilitates other persons to commit acts related to fake cards, fraudulent or fraudulent transactions; Overdraft transactions at Merchants (no purchase and sale of goods and services).
16.2.6 The Cardholder uses the card to perform transactions for money laundering, terrorist financing, scam, fraud, and other illegal conduct.
16.2 .7 The Cardholder violates the bank’ regulations and MasterCard; or agreements between the Cardholder and VIB.
16.2.8 VIB detects or suspects that the Cardholder is using false documents, information, or data, impersonation to issue the card or use the card for fraudulent purposes, deceit, or other illegal activities;
16.3 Cardholder has no transaction without blocking card and no outstanding balance on card account for 24 consecutive months;
16.3.1 The Cardholder dies, disappears, is arrested, is charged with criminal responsibility;
16.3.2 Assets being secured for issuing cards are seized, blocked or held.
16.3.3 Cases related to leaving work or income changes that result in the failure to meet the conditions for using the Card as provided by the bank;
16.3.4 Requests from competent authorities to serve the investigation and handling of crimes in accordance with the law.
16.4 If the bank does not receive a written request from the Cardholder to return the outstanding balance on the Card Account (if any) within 5 years from the date VIB receives the request to terminate the Card, VIB has the right to handle this amount of money as provided by VIB.
17. Limitation of the Bank’s Liability
The bank shall not be liable for any delay, failure or computer processing error in the extent that it is attributable to any cause beyond the Bank’s reasonable control providing any of the bank’s equipment or other facilities or services to the Cardholder to including any equipment malfunction or failure.
18. Variation of Term and Conditions
The bank has the right to amend any term and conditions of the Cardholder Agreement from time to time as it deems appropriate at its absolute discretion. Such amendments will be binding upon the Cardholder upon giving notice to the Cardholder using such means of notifications as the Bank shall deem appropriate (including but not limited to display in the premises of the Bank or any of its offices or in the Statements of Credit Cards or in the Bank’s website or by such other methods as the Bank may decide)
19. General Provisions
19.1 Card is the Bank’s property:
Card is the property of the Bank which will not be transferable and will be returned to the Bank immediately by the Cardholder upon the Bank’s request.
19.2 Changes of Cardholder’s information:
The Cardholder will notify the Bank promptly in writing of any changes in employment as well as address of working place, or residential address or other contact information.
19.3 Processing of Personal Data of the Cardholder, related parties of the Cardholder, and third parties
The Cardholder agrees that the notification regarding the processing of personal data, as approved by the Cardholder and/or publicly announced by VIB at any given time, is legally binding and effective between the Cardholder and VIB; it applies to all documents, information, and personal data of the Cardholder, related parties of the Cardholder, and third parties for the purpose of providing services to the Cardholder or addressing cases of suspected fraud, forgery, legal violations, and other cases as stipulated in the notification regarding the processing of personal data.
19.4 Recording verbal instructions or communications:
In the course of providing credit card services, the Bank may need to record verbal instructions received from the Cardholder and/ or any verbal communication between the Cardholder and the Bank in relation to such services.
19.5 Signature on sales slips/document related to Card Transactions:
For each purchase or cash advance transaction, Cardholder’s Signature on sales slip must match the registered Signature, expect For MOTO or Internet Transactions which Cardholder’s Signature is not required and are under the Bank’s agreement
19.6 For e-commerce transactions, the cardholder is in responsible for all risks related to the card transaction, including those that might arise from the merchant saving the cardholder's information (card-on-file), processing card transactions at the merchant using the saved card information, and carrying out card transaction authentication using any technique permitted by the International Card Organization.
19.7 Gambling or other illegal transactions: The Card shall not be used for payment of any gambling or other transaction which is illegal under any applicable laws and the Bank reserves the right to decline to process or paying any Card Transaction which it suspects to be a gambling or other transaction which is illegal. In the event that the Bank suspects, believes or otherwise has knowledge that and Card Transaction effected is for the purpose of or is otherwise related to gambling or a transaction which is illegal under any applicable or relevant laws, the Bank reserves the right to reverse or cancel that Card Transaction.
19.8 Card Account related documents:
the Bank reserves the right to destroy any documents relating to the Card Account after microfilming the same.
19.9 Notification
Notification Any notification sent by VIB under this Agreement may be executed and deemed received by the Cardholder (i) at the time of delivery if delivered in person, or delivered to the registered address, or (ii) on the third day after the date of sending if sent via postal service, or (iii) at the time of sending if sent via email, messaging services through phone numbers, mobile applications (SMS, ZMS), fax, or telex, or (iv) at the time of posting or publication (or at the time specified by VIB in that notification) if posted at VIB's headquarters or at VIB's transaction locations, or published on VIB's official website.
By registering for the issuance and use of the Card, it is understood that the Cardholder requests and VIB agrees to update the regarding products, services, promotional programs, events, notifications related to the credit contract, and other useful information, including content containing links to electronic news pages or mobile applications.
Unless otherwise specified, the Cardholder may send notifications to VIB in the following ways: (i) by making a direct request at VIB's branches/transaction offices, or (ii) by calling the 24/7 Customer Care hotline as announced on VIB's website, or (iii) through other methods notified by VIB to the Cardholder at any given time. Notifications from the Cardholder are considered sent to VIB on the date VIB actually receives them.
19.10 Gambling or other illegal transactions:
The Card shall not be used for payment of any gambling or other transaction which is illegal under any applicable laws and the Bank reserves the right to decline to process or paying any Card Transaction which it suspects to be a gambling or other transaction which is illegal. In the event that the Bank suspects, believes or otherwise has knowledge that and Card Transaction effected is for the purpose of or is otherwise related to gambling or a transaction which is illegal under any applicable or relevant laws, the Bank reserves the right to reverse or cancel that Card Transaction.
19.11 Transfer of the Card and Personal Identification Number (PIN):
The Cardholder agrees that VIB has the full right to transfer the Card and Personal Identification Number (PIN) to the Cardholder via postal service or by any other method of delivery that VIB deems appropriate.
19.12 Card Validity Period VIB issues:
Card Validity Period VIB issues the Card with a maximum validity period of five (05) years from the date of issuance. The Supplementary Card will have the same validity period as the Primary Card. After the aforementioned validity period, VIB reserves the right to review and decide on the renewal of the Card according to VIB's regulations at any given time, including the option for automatic renewal of the Card. The renewal of the Card may be conducted each cycle with a maximum duration of five (05) years. VIB will notify the Cardholder of the Card renewal in Card, within the period specified in the notification, if the Cardholder agrees to VIB's renewal of the Card, the Cardholder must follow VIB's Cardholder's information, and any form. In cases where VIB performs automatic renewal of the notification to complete the verification measures, re-verify the Cardholder's information, and confirm agreement to renew the Card according to VIB's regulations at any given time.
19.13 Governing law:
This Agreement is governed by and construed in accordance with the laws of Vietnam
19.14 International Card Organization:
The Cardholder acknowledges and agrees that the Cardholder will comply with the regulations of the International Card Organization related to Card Transactions ( as indicated by the branding on the Card)
