1. Fee schedule

Terms and Conditions on Issuance and Use of VIB International Debit Cards

1. Notice of Card Issuance

Notice of Approval for Issuance of debit cards includes information on Cardholder's name, Card type and other information as prescribed by VIB from time to time, which will be notified by VIB to Cardholder at the time Cardholder is approved by VIB to issue the VIB International Debit Cards.

 

2. General responsibilities of Cardholder, including the primary Cardholder and the Supplementary Cardholder depending on the context ("Cardholder")

2.1 Cardholder must provide complete, accurate and timely information, documents and data as required by VIB to verify and identify Cardholder when registering for Card Issuance and Use and during the process of using debit cards, Cardholder must be responsible for the truthfulness of the information, documents and data he/ she provides.

 

2.2 Cardholder (1) must sign the signature strip on the back of debit cards immediately upon receiving debit cards, (2) must not allow anyone to use debit cards, (3) must always keep debit cards, keep Cardholder's Personal Identification Number ("PIN"), other identification numbers of the Cardholder, Card information, transaction information confidential, (4) must not disclose Card information. 

 

2.3 After VIB issues debit cards: (i) if Cardholder activates debit cards before receiving the physical Card by performing a Card information query and activating debit cards via VIB's online service application software ("MyVIB"): in this case, Cardholder is only allowed to perform e-commerce transactions within the Transaction Limit; After receiving the physical Card, Cardholder needs to log in to MyVIB to enable the features to perform other transactions under Card Transactions; or (ii) if Cardholder activates debit cards after receiving the physical Card by activating debit cards via MyVIB or the 24/7 Customer Service Department at the phone number updated on VIB's official website, and after debit cards are activated: in this case, Cardholder is allowed to perform Card Transactions.

 

2.4 Cardholder (i) directly comes to VIB to receive debit cards/ PIN and signs debit cards/ PIN Delivery Minutes with VIB if Cardholder registers to receive debit cards/ PIN at VIB or (ii) receives debit cards/ PIN at the registered address through the Delivery Partner that VIB cooperates with from time to time. Cardholder must come to receive debit cards within 90 days from the date VIB issues debit cards (for Cards registered for issuance and received at any Branch or business unit of VIB) or Cardholder receives debit cards at the registered address to receive debit cards (for the electronically issued cards). 

 

2.5 Cardholder must change the PIN at VIB's automated teller machine (ATM) or on MyVIB when using debit cards for the first time or when receiving a reissued PIN.

 

2.6 Cardholder is responsible for all Card Transactions, fees, and Payments required below without being affected by the termination of these Terms.

 

2.7 Cardholder may only make Card Transactions by electronic means when Cardholder has completed the verification to ensure that the identity documents and biometric information of Cardholder match the provisions of law and regulations of VIB in each period.

2.7.1 Cardholder does not install applications or access links of unknown origin and does not grant accessibility rights to the application.

3. Limits

3.1 Available Limit: The maximum amount Cardholder is allowed to spend at any one time. The Available Limit is equal to the Available Balance of the Debit Card Account.

 

3.2 Transaction Limit: Each Card is granted a limit for each type of transaction including payment for goods, services, cash withdrawals and other forms of transactions ("Card Transactions") as determined by VIB at its sole discretion at each period.

3.2.1 Cardholder proactively adjusts the Daily Transaction Limit and the Daily Online Transaction Limit according to spending needs and locks on MyVIB when there is no need to use it.

 

4. Card Transactions

4.1 Cash withdrawal transactions are transactions in which Cardholder receives cash at ATMs and/ or other methods in accordance with the provisions of law.

 

4.2 For transactions of payment for goods and services, VIB is not responsible for the method of providing goods/ services or any refusal by the Merchants (“the Merchant”) (except for technical errors related to the use of debit cards). VIB will also not be responsible for any goods or services provided to Cardholder in any manner. A complaint by Cardholder against the Merchant will not release Cardholder from its obligations to VIB under these Terms. VIB reserves the right to change or terminate any agreement with Cardholder in the event of a dispute between Cardholder and the Merchant. 

 

4.3 All Card Transactions in currencies other than Vietnamese Dong, Card Transactions will be provisionally debited to the Debit Card Account after converting Card Transaction value to Vietnamese Dong determined according to the exchange rate prescribed by VIB from time to time on the date of Card Transaction plus (i) related fees prescribed by VIB in card service fee schedule (including but not limited to: overseas cash withdrawal fee, foreign currency transaction management fee) and (ii) the exchange rate difference estimated by VIB (between the date of Card Transaction and the date VIB actually pays Card Transaction value to the International Card Organization (ICO)) ("Provisional Debit"). Card Transaction value will be converted back according to the exchange rate prescribed by VIB from time to time on the date of actual payment, the difference (if any) will be credited to the Debit Card Account. 

Conversion to Vietnamese Dong in case that Card Transactions are made in currencies other than Vietnamese Dong is carried out on a case-by-case basis as follows: (i) Card Transactions in US Dollars will be converted to Vietnamese Dong; (ii) Card Transactions in all currencies rather than US Dollars or Vietnamese Dong will be converted directly to Vietnamese Dong or first converted to US Dollars and then to Vietnamese Dong according to Regulations of VIB. 

 

4.4 Card Transactions selected to be made in Vietnamese Dong at foreign merchants or at merchants managed by foreign entities will be temporarily debited to the Debit Card Account after converting Card Transaction value to Vietnamese Dong determined according to the exchange rate prescribed by VIB from time to time on the date of Card Transaction plus (i) related fees prescribed by VIB in card service fee schedule (including but not limited to: Foreign currency transaction management fee) and (ii) the exchange rate difference estimated by VIB (between the date of Card Transaction and the date VIB actually pays Card Transaction value to the International Card Organization) ("Provisional Debit"). Card Transaction value will be converted back according to the exchange rate prescribed by VIB from time to time on the date of actual payment, the difference (if any) will be credited to the Debit Card Account.

 

4.5 Cardholders are not allowed to use debit cards for illegal purposes. 

4.5.1 Cardholders are not allowed to use debit cards to make payment transactions on foreign websites that are not in accordance with the provisions of Vietnamese law (such as buying and selling foreign currency; stocks; virtual currency; gambling; betting, etc.);

4.5.2 Cardholders are not allowed to use debit cards for fraudulent, deceptive purposes or other illegal purposes or activities.

4.5.3 Cardholders are responsible for registering for SMS Banking and MyVIB services when issuing debit cards to promptly manage Cardholder's Card Transactions and perform online Card Transactions. Cardholders are responsible for not immediately notifying VIB when Cardholder does not use debit cards but still receives messages about card transactions, except in cases where errors are determined to arise from VIB.

5. Card-Accompanying Utilities

From time to time, VIB may introduce new products, services or accompanying support to Cardholders to meet the requirements of Cardholders, including but not limited to requests to open/ lock Cards, change information, open/ lock Card transactions via e-commerce, reissue Cards/ PINs, support services to automatically update Card information on websites/ applications after changing the type of Card product/ replacing/ renewing Cards and any other services. Cardholders may contact VIB to learn more about how to use or how to set up requests for these services. Cardholders need to carry out procedures and submit relevant documents to register for the above services according to Regulations of VIB from time to time. New products and services are governed by specific terms for such products and services. In the event of any conflict between those specific terms and these Terms, the specific terms for those products and services shall prevail.

6. Lost, Stolen, Disclosed or Misused Card or PIN

6.1 In the event that debit cards and/ or PIN is lost, stolen, disclosed or misused to conduct fraudulent or counterfeit transactions (hereinafter collectively referred to as “Illegally abused cards”), Cardholder must immediately notify any VIB Branch or business unit in writing or by calling the 24/7 Customer Service Department from the phone number registered at VIB at the phone number updated on VIB’s official website. After notification, Cardholder must officially confirm this notification in writing to VIB. VIB will confirm the processing of the notice received from Cardholder in writing, or by email, or by phone from the 24/7 Customer Service Department or any other form that VIB deems appropriate within 05 working days from the date VIB receives the notice from Cardholder.

 

6.2 In case debit cards are abused before VIB locks debit cards (the time of locking debit cards will be stated in the confirmation under Article 6.1 on the processing of the notice received from Cardholder), Cardholder must fully bear the damage and compensate for the damage caused by debit cards being Abused. Cardholder confirms and agrees that: Cardholder is still responsible for paying VIB all fees and total transaction value of Card Transactions by the Abused Card before VIB locks debit cards on the date decided by VIB at its sole discretion.

 

6.3 In case debit cards are abused after VIB has locked debit cards (the time of locking debit cards will be stated in the confirmation under Article 6.1 regarding the handling of the notification received from Cardholder), VIB is obliged to compensate Cardholder for damages caused by debit cards being abused after the time VIB has locked debit cards.

7. Handling of Investigations and Complaints

7.1 Requests for investigation and complaints related to debit cards (if any) are received at any VIB Branch or business unit or through the 24/7 Customer Service Department at the phone number updated on the official website of VIB. In case Cardholder requests an investigation or complaint on the grounds of suspicion of not performing or not performing a transaction through the 24/7 Customer Service Department, Cardholder must supplement the Request for investigation and complaint within (05) five working days.

 

7.2 In case Cardholder authorizes another person to request an investigation or complaint, Cardholder shall comply with the provisions of law on authorization and in accordance with these Terms. 

 

7.3 Requests for investigation or complaints related to Card Transactions must comply with the regulations of VIB and the International Card Organization whose Card is branded. When handling investigations or complaints, VIB and Cardholder shall be bound by the results of the investigation or complaint and shall be subject to the regulations of these regulations.

 

7.4 Cardholder must return the physical Card to VIB within one working day from the time VIB receives the first investigation or complaint request related to suspected fraudulent or counterfeit transactions (including but not limited to: transactions using counterfeit Cards and/ or other cases as required by VIB.

 

7.5 In order to request an investigation or complaint, Cardholder shall be responsible for providing VIB with the following information and documents:

  • Regarding Cardholder: information, documents, data necessary to verify Cardholder's information, ensuring that it matches Cardholder's information stored at VIB, according to Regulations of VIB from time to time;
  •  Regarding transactions subject to verification and complaints: Card number/ Card Account number, transaction quantity, transaction value, Merchant, transaction time, transaction results, other information as required by VIB;

In case of request for verification and complaint of fraudulent or counterfeit transactions in which Cardholder must return debit cards to VIB: (i) Card revocation record or documents proving that Cardholder is holding debit cards at the time of the request for verification and complaint and cannot return debit cards due to being too far from the nearest VIB transaction location; and (ii) a copy of the Passport in case Cardholder's country of residence at the time of the transaction is different from the country where the suspected fraudulent or counterfeit transaction occurred and/ or documents proving that Cardholder did not participate in the transaction. In case Cardholder is abroad, documents proving that Cardholder cannot surrender debit cards within the prescribed time include but are not limited to: A scanned copy sent by email/ a photo sent by phone of the front of debit cards and the passport page showing the date of entry with the stamp of the Customs of the country where Cardholder entered; or a fax with the front of debit cards and recording the fax number with the country code of Cardholder's residence. The time limit for providing these types of documents is one working day from the time VIB receives the first investigation or complaint when such investigation or complaint arises. 

 

7.6 The time limit for Cardholder to request an investigation or complaint shall not exceed 60 calendar days from the date of Card Transaction for which the investigation or complaint is requested; from the second time onwards, it is 05 working days from the date VIB notifies Cardholder of the results of the investigation and complaint handling. VIB will not bear any responsibility if Cardholder requests an investigation or complaint beyond the above time limit.

The maximum time limit for handling a request for investigation or complaint shall not exceed (i) 05 working days/ inquiry for transactions at VIB's ATMs or (ii) 55 calendar days/ inquiry (or another time limit as prescribed by the International Card Organization from time to time) for the remaining transactions requiring investigation or complaint, including Card Transactions on Card acceptance devices of other banks from the time all of the following conditions are met: (i) VIB receives the request for investigation or complaint; (ii) Cardholder provides full documents as required by VIB; (iii) Card Transaction has been recorded on Cardholder's statement; and (iv) the advance payment stated in Article 7.10 has been credited to the Card Account if the investigation and complaint are resolved through international arbitration.

 

7.7 In case the loss arises not due to the fault of Cardholder and/ or does not fall under the cases of VIB's Limitation of Obligations in the Terms, based on the results of the investigation and complaint handling, VIB will reimburse Cardholder within 05 working days from the date VIB notifies Cardholder of the results of the investigation and complaint handling. In case the deadline for handling the investigation and complaint request has expired but the cause or fault of which party has not been determined, within the next 15 working days, VIB will negotiate with Cardholder on a plan to handle the results of the investigation and complaint.

 

7.8 In case the case shows signs of crime, VIB will notify the competent state agency in accordance with the provisions of the law on criminal proceedings and report to the State Bank (Payment Department, State Bank branches in the province or city in the area); at the same time, notify Cardholder in writing about the status of handling the request for investigation and complaint. In case the competent state agency announces the settlement result without criminal elements, within 15 working days from the date VIB receives the conclusion of the competent state agency, VIB will make an agreement with Cardholder on the plan to handle the investigation and complaint results. 

 

7.9 Cardholder must pay the incorrect complaint fee according to VIB's fee schedule in case Cardholder requests an incorrect investigation or complaint. The incorrect complaint fee is applied when VIB receives the investigation or complaint result of Cardholder's transaction from the International Card Organization concluding that the investigation or complaint of Cardholder is invalid (for transactions on debit cards acceptance system of other banks) or recorded in the VIB system as invalid (for transactions on debit cards acceptance system of VIB).

 

7.10 Cardholder is responsible for paying the amount of the disputed Card Transaction, the fees incurred according to the regulations of the International Card Organization and the fees and costs that VIB must bear ("Payables") when the dispute is brought to International Arbitration and the decision is in favor of Cardholder. To ensure Cardholder's responsibility to pay the Amounts Payable for Card Transactions submitted to International Arbitration, Cardholder agrees to transfer the provisional amount as notified by VIB at the steps of handling the investigation and complaint procedures to the Debit Card Account and maintain this provisional amount on the Debit Card Account during the dispute settlement period to pay the Amounts Payable. As soon as the provisional amount is credited to the Debit Card Account, Cardholder, by this Terms, requests and agrees that VIB has the right to freeze this provisional amount during the time the International Arbitration resolves the dispute. In the event that the International Arbitration rules that Cardholder loses the case, Cardholder, by this Terms, unconditionally and irrevocably authorizes VIB to automatically the Debit Card Account to pay the Amounts Payable. If Cardholder does not transfer the advance payment in accordance with the amount and time limit notified by VIB, it is understood that Cardholder withdraws the request for verification and complaint regarding the disputed Card Transaction and VIB will stop processing Cardholder's request for verification and complaint.

 

7.11 If Cardholder does not agree with the results of the verification and complaint settlement notified by VIB, the verification and complaint will be resolved in accordance with the provisions of law.

 

7.12 VIB has the right to refuse any verification and complaint requests related to debit cards after the above verification and complaint request deadline. At the same time, VIB has the right to refuse to accept requests for verification and complaints of Card Transactions with a value of less than USD 25 (in words: twenty-five American dollars) or equivalent value at the POSs of the tourism and entertainment type according to the regulations of the International Card Organization in each period (such as Airlines, car rental services, cruises, trains, hotels, motels, restaurants, travel agencies, etc.) and Card Transactions with a value of less than USD 10 (in words: ten American dollars) or equivalent value at POSs of other types. Cardholder is obliged to make full payment of the amount of these transactions including all related fees and is responsible for any loss or damage (if any) arising from or related to these transactions.  

 

7.13 VIB will notify Cardholder of the results of the investigation and complaint handling in writing, or by email, or by phone from the 24/ 7 Customer Care Department or any other form that VIB deems appropriate.

8. Cases of Card Payment Rejection.

8.1 Debit cards are locked according to Article 11 of these Terms;

 

8.2 Debit cards have expired or is requested to be invalidated by Cardholder/ VIB;

 

8.3 Debit cards are counterfeit or related to fraudulent, counterfeit, or fictitious transactions at the Merchant and transactions prohibited by law on non-cash payments;

 

8.4 Debit cards have been reported lost by Cardholder;

 

8.5 The physical Debit cards have a defective Chip or magnetic strip;

 

8.6 Card Payment device or organization cannot successfully connect to VIB;

 

8.7 Debit cards’ PIN is entered wrongly; 

 

8.8 Cardholder uses debit cards to conduct transactions for the purposes of money laundering, terrorism financing, fraud, cheating and other illegal acts;

 

8.9 Use of the debit cards in the transactions by electronic means while the electronic transaction function is locked;

 

8.10 Cardholder has not provided complete information and/ or provided incorrect transaction authentication information (CVC  and/ or OTP ) and/ or Cardholder's biometric information does not match when conducting transactions by electronic means;

 

8.11 The Available Limit is not sufficient to cover the payment. The provisions of this Article do not apply to Card Transactions that have not been recorded immediately at the time of use of debit cards by Cardholder according to the regulations of the International Card Organization;

 

8.12 The value of Card Transaction exceeds the transaction limit/ time, number of transactions / days, transaction limit/ day according to regulations of VIB (if any);

 

8.13 Cardholder violates the regulations of VIB, Card Payment Organization, Card Payment Bank or the agreements between Cardholder and VIB;

 

8.14 In case of temporary suspension of Card Transactions according to Article 12 of these Terms;

 

8.15     In other cases according to regulations of VIB. 

9. Fees

Cardholder agrees to pay VIB the issuance fee, maintenance fee to maintain debit cards, and other fees as prescribed in VIB's fee schedule from time to time. These fees will be debited to the Debit Card Account as soon as debit cards are issued, even if debit cards have not been activated and will not be refunded.

If VIB incurs any legal or other costs (a reasonable amount for a claim, lawsuit, recovery, repossession for the purpose of recovering any amount due to Cardholder under these Terms) or costs to implement remedial measures due to Cardholder's failure to perform or comply with any provision of these Terms, Cardholder must reimburse VIB immediately upon VIB's request for reimbursement of these costs. If Cardholder fails to reimburse these costs, VIB has the right to continue to charge interest on the unreimbursed amount at the interest rate specified in the Service Fee Schedule and debit cards Interest Rate applicable at that time.

The fee or percentage of the fee or cost mentioned in these Terms is applied according to the regulations in the fee schedule of VIB from time to time. Cardholder is bound to comply with such regulations of VIB.

9.1 Card service fee schedule is published on the official website of VIB. VIB reserves the right to change card service fee schedule at any time that VIB deems appropriate. VIB will notify Cardholder in one of the following ways: (i) sending a notice via email or (ii) posting at VIB's headquarters or at VIB's transaction locations, or (iii) posting on VIB's official website, or (iv) posting on MyVIB, or (v) in another way as determined by VIB. The changed Card service fee schedule will take effect from the date stated in VIB's notice but no earlier than 07 days from the date VIB sends the notice.

If Cardholder does not agree with this revised Card service fee schedule, Cardholder may terminate the use of debit cards within 07 days from the date VIB sends the notice. In case Cardholder does not terminate the use of debit cards, Cardholder acknowledges and agrees that Cardholder will be deemed to have accepted this revised Card service fee schedule. Cardholder’s continued use of the VIB Card after the effective date of the revised Card Service Fee Schedule shall be conclusive evidence of Cardholder’s acceptance to be bound by such amendments.

10. Supplementary Cards

If VIB issues a Supplementary Card at the joint request of the Primary Cardholder and the Supplementary Cardholder (“Supplementary Card”), the Supplementary Cardholder shall be bound by the provisions of these Terms and Conditions and shall be responsible for the use of the Supplementary Card, but the Primary Cardholder shall remain responsible for the use of both his/ her Card and the Supplementary Card. VIB reserves the right to collect fees for the Supplementary Card from any Primary Cardholder or Supplementary Cardholder or both. In the event of termination of the Supplementary Card as set out in Clause 14.2 below, the Primary Cardholder shall be responsible for any payments arising from the use of the Supplementary Card until the Supplementary Card is returned or until VIB can carry out the procedures applicable to the lost Supplementary Card if requested by the Supplementary Cardholder or the Primary Cardholder. The Supplementary Cardholder shall not be responsible for the use of debit cards by the Primary Cardholder or any other Supplementary Cardholder.

11. Cases of Temporary Locking/ Locking of Cards

11.1 At the request of Cardholder; or

 

11.2 VIB has the right to lock debit cards without prior notice to Cardholder in the following cases:

11.2.1 Debit Cards’ PIN is entered wrongly for 3 times in a row at the ATM;

11.2.2 Debit cards arising transactions/ in connection to fraud, forgery; fictitious payment transactions; use of cards for improper purposes registered with VIB;

11.2.3 Debit cards/ Cardholder generates signs of early risk identification criteria according to Regulations of VIB from time to time, including but not limited to criteria on transactions, Merchants generating transactions, and changes in Card status;

11.2.4 The information, documents, and data provided by Cardholder are incomplete according to Regulations of VIB, inaccurate, dishonest, or untrue;

11.2.5 The identity documents of Cardholder who is a Vietnamese or foreigner, and documents proving the residence period of Cardholder who is a foreigner residing in Vietnam have expired, according to information stored at VIB;

11.2.6 Cardholder has not completed the verification to ensure that the identity documents and biometric information of Cardholder match according to the provisions of law and regulations of VIB in each period (applicable to Card transactions by electronic means).

11.2.7 Debit cards’ information is disclosed at the Merchant; 

11.2.8 Debit cards are stolen or lost;

11.2.9     Cardholder uses debit cards to conduct transactions for the purposes of money laundering, terrorism financing, fraud, cheating and other illegal acts;

11.2.10 Cardholder notifies that he/ she will not conduct Card Transaction;

11.2.11 Debit cards are related to a subject that violates the law on cards as notified by the State Bank, competent authorities, members of Card Association, and Card Organizations of which VIB is a member.

11.2.12 Cardholder does not pay debit cards maintenance fee as prescribed by VIB;

11.2.13 Cardholder has lost or has limited civil capacity;

11.2.14 VIB has the right to lock debit cards if Card Transaction and/ or the accounting amounts related to the use of debit cards have not been properly and fully accounted for, including cases due to technical errors and/ or regulations of the International Card Organization.

11.2.15 Other cases as prescribed by law and the International Card Organization.

VIB has the full right to decide whether or not to restore the provision of Card services to Cardholder. In case VIB does not restore the provision of Card services, debit cards will be revoked and/ or invalidated according to the provisions of these Terms.

12. Cases of Temporary Suspension of Card Transactions

In case VIB upgrades, edits, completes technology solutions and/ or systems, due to force majeure or other cases as prescribed by law, VIB has the full right to decide to temporarily suspend Card Transactions, the time of temporary suspension of Card Transactions as well as notify Cardholder of the suspension and the time of temporary suspension of such Card Transactions.

13. Cases of Card Revocation

VIB has the right to revoke debit cards in the following cases:

13.1 Counterfeit Card; Illegal use of cards;

 

13.2 Cardholder uses debit cards for purposes other than those registered with VIB and/ or to conduct transactions for the purposes of money laundering, terrorist financing, fraud, cheating and other illegal acts;

 

13.3 Cardholder fails to prove that he/ she is Cardholder;

 

13.4 Cardholder fails to comply with the regulations of VIB and the International Card Organization of which VIB is a member regarding the use of debit cards;

 

13.5 Cardholders’ PIN is entered wrongly for 3 times in a row at the ATM;

 

13.6 VIB detects or suspects that Cardholder uses fake documents, information, data, or impersonation to issue debit cards or uses debit cards for the purpose of fraud, cheating or other illegal activities;

 

13.7 In order to serve the investigation and handling of crimes in accordance with the provisions of law;

 

13.8 Cardholder and Card information are on the embargo list of the State Bank, of International Card Organization and of VIB or are subject to transaction restrictions according to VIB's policies from time to time;

 

13.9 Other cases according to Regulations of VIB from time to time.

14. Cancellation of Card Use

14.1 Cardholder may terminate debit cards’ validity at any time by sending a notice along with returning debit cards and any other Supplementary Cards according to Regulations of VIB on termination of Card use from time to time. Cardholder must fulfill all debt obligations arising during the process of opening and using debit cards.

 

14.2 If the primary Cardholder terminates the use of debit cards, the Supplementary Cardholder must automatically terminate the use of debit cards. The primary Cardholder has the right to request VIB to stop using the Supplementary Cardholder's Card without the consent of the Supplementary Cardholder.

 

14.3 VIB may cancel Cardholder's Card without prior notice in the following cases:

14.3.1 Cardholder does not receive debit cards within 90 days from the date debit cards are issued (newly issued/ renewed/ reissued/ replaced) on the VIB Card management system, except in cases where Cardholder has activated debit cards before receiving the physical Card;

14.3.2 Cardholder performs, organizes the performance or facilitates others to perform acts related to fake Cards, fraudulent transactions, counterfeit transactions, fictitious transactions (without the purchase and sale of goods and provision of services);

14.3.3 Cardholder uses debit cards to conduct transactions for the purposes of money laundering, terrorism financing, fraud, cheating and other illegal acts

14.3.4 VIB detects or suspects that Cardholder uses fake documents, information, data, impersonation to issue cards or uses cards for the purpose of fraud, cheating or other illegal activities;

14.3.5 The cards are issued in the following cases: (i) 01 (One) Card Account is associated with multiple Cards, (ii) Primary Cardholder and Supplementary Cardholder are the same person. In case of canceling the validity of debit cards according to the provisions in item (i) of this Article, in case Cardholder has multiple Cards, VIB has the right to choose to cancel the validity of debit cards according to Regulations of VIB from time to time.

14.3.6 Cardholder violates the regulations of VIB, the International Card Organization (ICO), Card Payment Bank, these Terms or other agreements between Cardholder and VIB;

14.3.7 Cardholder has no transactions without a notice of blocking debit cards for 24 consecutive months;

14.3.8 Cardholder dies, goes missing, loses or has limited civil capacity, is arrested, or is prosecuted for criminal liability;

14.3.9 Debit cards are returned by another Bank due to being confiscated at an ATM; or debit cards are confiscated by VIB from Cardholder;

14.3.10 Debit cards are expired;

14.3.11 Request from a competent authority to serve the investigation and handling of crimes according to the provisions of law.

 

14.4 Termination of these Terms and/ or cancellation of debit cards shall not release Cardholder from payment obligations for outstanding balances on the Debit Card Account (if any).

 

14.5 Within 5 years from the date of termination of debit cards use, if VIB does not receive a written request from Cardholder for the refund of the remaining balance on the Debit Card Account (if any), VIB shall have the full right to handle this amount of Cardholder in accordance with Regulations of VIB.

15. Card Cancellation Event

Cardholder must destroy debit cards by cutting debit cards into small pieces immediately after one of the following events occurs: (i) Debit cards are replaced, renewed, or damaged; (ii) Debit cards are invalidated as prescribed in these Terms and Conditions; (iii) Debit cards have been reported as lost or misplaced but is later found by Cardholder; (iv) The validity period (if any) stated on debit cards have expired.

16. Limitation of VIB's Obligations in Force Majeure Events.

16.1 VIB shall not be liable for any delay, breach or computer processing error, including any functional or equipment failure, in providing any banking equipment, facility or service to Cardholder if such delay, breach or computer processing error is beyond VIB's reasonable control.

 

16.2 VIB shall not be liable in the event of war, invasion, foreign attack, rebellion, revolution, riot, civil war, riot, requisition, or other civil or military acts, laws, regulations, acts or orders of any government agency, mechanism, intermediary or official, embargo, natural disaster, fire, severe weather, flood, strike, epidemic (from any cause), or other events, force majeure that the parties cannot foresee and cannot overcome.

17. Amendment of these Terms

Cardholder agrees that VIB has the full right to amend any provision of these Terms at any time that VIB deems appropriate. VIB will notify Cardholder in the forms specified in Article 18.9. The amended Terms shall take effect from the date stated in the notice of VIB but not earlier than 07 days from the date of notice sent by VIB.

If Cardholder does not agree with this amended Terms, Cardholder may terminate the use of debit cards within 07 days from the date of notice sent by VIB. In case Cardholder does not terminate the use of debit cards, Cardholder acknowledges and agrees that Cardholder shall be deemed to have accepted this amended Terms. Cardholder's continued use of the VIB Card after the effective date of the amended Terms shall be the final evidence of Cardholder's acceptance to be bound by these amendments.

18. General Terms

18.1 Debit cards are the property of VIB

Debit cards are the property of VIB and shall not be transferable, Cardholder shall immediately return debit cards to VIB upon VIB's request.

 

18.2 Changes in Information on the Cardholder

Cardholder is responsible for promptly notifying VIB in writing of any changes in employment, work address, residential address and other information that Cardholder has registered with VIB.

 

18.3 Processing of personal data of Cardholder, Cardholder's related person, other third parties

Cardholder agrees that the Notice on processing of personal data as approved by Cardholder and/ or notified and publicly announced by VIB from time to time is legally binding and effective between Cardholder and VIB; applied to adjust all documents, information, personal data of Cardholder, Cardholder's related person, other third parties to serve the provision of services to Cardholder or to handle cases of suspected fraud, forgery, violation of legal regulations and other cases as prescribed in the Notice on processing of personal data.

 

18.4 Recording of verbal instructions or information

In the course of providing card services, VIB shall have the right, but shall not be obliged, to agree to or act upon any verbal instructions or information given directly, by telephone, email, text message or any other electronic means (hereinafter collectively referred to as “instructions”) which VIB believes to be given or made or authorized by Cardholder. Where VIB decides to act upon such instructions, VIB shall be entitled to treat such instructions as having been fully authorized by Cardholder and as binding on Cardholder (regardless of whether verification checks or other security measures have been implemented) as if such instructions were given in a duly signed written form. VIB shall have the right to record verbal instructions received from Cardholder and/ or any verbal communications between Cardholder and VIB in relation to such services.

 

18.5 Electronic signature on invoices/ documents related to debit cards

For all transactions related to debit cards or requests to register for programs related to debit cards, Cardholder can sign directly with the same sample signature or use the electronic signature specified in the Terms and Conditions for using e-Banking services at VIB.

For Card Transactions in the form of e-commerce payment, Cardholder agrees that Card Transaction is authenticated in accordance with the method prescribed by the International Card Organizations corresponding to debit cards brand issued and/ or Regulations of VIB from time to time. Cardholder shall bear all risks arising from and/ or related to such Card Transaction, including risks arising from Cardholder storing Card information at the Merchant, from performing Card Transactions using debit card information stored at the Merchant, and from performing Card Transaction authentication in any method with the International Card Organization.

 

18.6 Any certificate, document, notice or document from VIB regarding the amount, other information of Card Transaction will be the sole and authentic evidence of Cardholder and/ or the person authorized by Cardholder performing Card Transaction.

 

18.7 VIB is entitled to automatically the Debit Card Account for: (i) fees related to the use of debit cards, (ii) Card Transactions (including Card Transactions that have not been recorded immediately at the time of use of debit cards by Cardholder according to the regulations of the International Card Organization), (iii) amounts credited erroneously or inaccurately to Cardholder's Card Account related to the use of debit cards according to the regulations on exchange rates (if the currency is not Vietnamese Dong) and other regulations of VIB (hereinafter collectively referred to as "Payable Amounts"). In case the Debit Card Account does not have enough Available Balance to pay the Payable Amounts, VIB is entitled to automatically debit any of Cardholder's payment accounts at VIB to collect these Payable Amounts.

 

18.8 Documents related to the Debit Card Account

VIB is entitled to cancel documents related to the Debit Card Account according to Regulations of VIB from time to time.

 

18.9 Notices

Any notice sent by VIB under these Terms may be made and deemed to have been received by Cardholder (i) at the time of delivery if delivered in person, or delivered at the registered address, or (ii) on the third day after the date of sending if sent by post, or (iii) at the time of sending if sent by email, SMS, ZMS, My VIB application, fax or telex, or (iv) at the time of posting, announcement (or the time VIB specifies in such notice) if posted at VIB's headquarters or at VIB's transaction locations, or announced on VIB's official website.

Unless otherwise specified, Cardholder may send notices to VIB by: (i) direct written requests at VIB's Branches/ Transaction Offices or (ii) calling the 24/ 7 Customer Care Department phone number announced on VIB's website, or (iii) other forms notified by VIB to Cardholder from time to time. Cardholder's notices are considered to be sent to VIB on the actual date of receipt by VIB.

Cardholder may contact VIB via the 24/ 7 Customer Care Department phone number for support, advice and answers to questions about products or services provided by VIB. Cardholder may view detailed card transaction history, account balance and other information related to card services on the MyVIB application or via any other form applied by VIB from time to time.

 

18.10 Gambling or other illegal transactions

Debit cards shall not be used to pay for gambling payments, or other illegal transactions under current laws that VIB has the right to refuse to process or refuse to pay. In case VIB suspects, believes or knows that any Card Transaction is made for these purposes or related to gambling or an illegal transaction under current or related laws, VIB has the right to withhold or cancel the transaction through that Card without incurring any legal responsibility and civil obligation to Cardholder and any third party.

 

18.11 Validity of the Debit Cards

VIB issues Cards with a maximum validity period of five (05) years from the date of issuance. Supplementary Cards will have the same validity period as the Primary Card. After the above-mentioned validity period, VIB has the full right to consider and decide to renew debit cards according to Regulations of VIB at each period, including automatic Card renewal. Card renewal can be done each cycle with a maximum term of five (05) years. VIB will notify Cardholder of debit cards renewal in any form. In case VIB automatically renews debit cards, within the time specified by VIB in the notice, if Cardholder agrees to VIB's Card renewal, Cardholder shall follow VIB's notice to complete the authentication measures, re-verify Cardholder's information and confirm agreement to renew debit cards according to Regulations of VIB at each period. 

 

18.12 By registering for the Issuance and Use of debit cards, it is understood that Cardholder requests and VIB agrees to update Cardholder with information on products, services, promotions, events, notices related to the Credit Card Issuance and Use Contract and other useful information, including content containing links to VIB's website and mobile applications.

 

18.13 Governing Law

These Terms are governed by and comply with the laws of Vietnam. 

 

18.14 Regulations of the International Card Organization

Cardholder acknowledges and agrees that Cardholder will comply with the regulations of the International Card Organization related to Card Transactions (labeled on debit cards).
